By accessing or using Octave Athletics (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Octave Athletics is an online coaching platform for middle-distance runners. We provide tools for coaches to create training plans, communicate with athletes, and manage their coaching practice. Athletes can follow training plans, track performance, and communicate with their coaches.
3. Account Registration
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your password and for all activity under your account.
4. Subscription and Payments
Certain features require a paid subscription. Subscriptions are billed monthly through Stripe. You may cancel at any time through the billing portal. Refunds are handled in accordance with our refund policy. Free trials, when offered, convert to paid subscriptions unless cancelled before the trial period ends.
5. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Harass, threaten, or intimidate other users
- Upload malicious content or attempt to compromise system security
- Misrepresent your identity or coaching credentials
- Resell or redistribute the Service without authorization
6. Coach Responsibilities
Coaches using the platform are solely responsible for the training plans and advice they provide. Octave Athletics does not verify coaching credentials and is not liable for training outcomes, injuries, or health issues resulting from coaching advice delivered through the platform.
7. Intellectual Property
Training plans and content created by coaches remain their intellectual property. Octave Athletics retains the right to use the Service design, software, and branding. You grant us a limited license to display your content as necessary to operate the Service.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, Octave Athletics shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
11. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time through the account settings page.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify users of material changes via email or in-app notice.
